1. Acceptance of Terms

By downloading, installing, or using Pars IPTV Player ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Pars IPTV Player regarding your use of the App.

2. Eligibility

This App is not intended for use by children under the age of 13. By using the App, you represent that you are at least 13 years old. Users between 13 and 18 years of age should use the App with parental or guardian awareness.

3. Service Description

Pars IPTV Player is a media player application that allows users to play media content from user-provided sources, including Xtream Codes API and M3U playlists. New users receive a free trial period (as determined by the app store) with access to all features. After the trial period ends, a paid subscription is required to continue using the App. Without an active subscription, the App cannot be used.

4. Content Disclaimer

THE APP DOES NOT HOST, STORE, PROVIDE, STREAM, OR DISTRIBUTE ANY MEDIA CONTENT. All content accessed through the App is provided by third-party IPTV services selected, configured, and subscribed to by the user. We have no control over, and assume no responsibility for, the content, availability, privacy policies, or practices of any third-party IPTV services. You are solely responsible for:

• Ensuring you have the legal right to access content from your IPTV service provider
• Complying with all applicable copyright and intellectual property laws
• The legality and appropriateness of all content you access through the App

8. Cloud Sync and User Data

When you use Cloud Sync, certain data (playlists, favorites, watch history, settings) is stored on our servers in the European Union (Germany). You retain full ownership of your data. We claim no ownership over your user content. You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Cloud Sync service. We will not access, use, or share your data for any other purpose. Playlist credentials (usernames, passwords, URLs) are transmitted via encrypted HTTPS connection and stored encrypted on our servers. We do not have access to your IPTV service provider accounts.

9. Security Measures

The App employs security measures including device integrity checks (root/jailbreak detection), certificate pinning, request signing, and runtime protection to safeguard against unauthorized access, tampering, and fraud. The App may restrict functionality or terminate access on devices that have been rooted, jailbroken, hooked, or otherwise modified in ways that compromise security. In such cases, sensitive data stored locally may be cleared to protect your information.

10. Prohibited Uses

You agree not to:

• Use the App to access content you do not have legal rights to view
• Attempt to circumvent, disable, or interfere with security measures, DRM, or access controls
• Use the App for any illegal purpose or in violation of any applicable law
• Share, resell, rent, or transfer your account or subscription to another party
• Use automated systems, bots, scrapers, or similar tools with the App
• Interfere with, disrupt, or place an unreasonable burden on the App's servers or infrastructure
• Impersonate any person or entity, or misrepresent your affiliation
• Collect or harvest personal information of other users
• Use the App for competitive analysis or to build a competing product

11. Copyright Infringement / DMCA Policy

Pars IPTV Player respects the intellectual property rights of others. As the App does not host, store, or distribute any media content, copyright complaints should primarily be directed to the relevant content provider or IPTV service. However, if you believe that content accessible through our cloud sync or services infringes your copyright, you may submit a written notification to our designated agent containing:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and information sufficient to locate it
• Your contact information (name, address, telephone number, email)
• A statement of good faith belief that the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any content accessed through third-party IPTV services will be available, accurate, complete, or legal
• The App will be compatible with all devices, operating systems, or IPTV services
• Defects will be corrected in a timely manner
• The App will meet your specific requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARS IPTV PLAYER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, profits, revenue, or business opportunities
• Business interruption or loss of goodwill
• Damages arising from third-party content or services
• Damages resulting from unauthorized access to or alteration of your data
• Any other intangible losses

14. Indemnification

You agree to indemnify, defend, and hold harmless Pars IPTV Player and its team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights (including copyright and intellectual property)
• Any content you access through the App
• Your IPTV service provider's actions or content

We reserve the right to modify these Terms at any time. We will provide notice of material changes by displaying an in-app notification and posting the updated Terms with a new "Last updated" date. Your continued use of the App after the effective date of changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue using the App and delete your account.
